GenCueBox.com operates as an online platform and interactive service provider that allows independent creators to publish, share, and index user-generated artificial intelligence prompt strings, settings, and output preview images. Under the Digital Millennium Copyright Act (DMCA) Safe Harbor provisions (17 U.S.C. § 512), GenCueBox claims safe harbor protection from copyright liability for user-submitted uploads.

We do not proactively generate user submissions nor do we claim copyright ownership over prompts published by independent community creators. We respond expeditiously to properly submitted copyright infringement notices in full compliance with United States copyright laws and international intellectual property standards.

You should file a formal DMCA takedown notice only if you are the genuine copyright holder, or an agent legally authorized to act on behalf of the owner, and you hold a good faith belief that content hosted on GenCueBox directly infringes upon your copyrighted creative work.

A DMCA notice is not appropriate for general interpersonal disagreements, trademark disputes (which are governed by separate policies), stylistic inspiration that does not copy protectable expression, or content that qualifies as recognized Fair Use under applicable law.

Formal DMCA notices may be submitted to our Designated Copyright Agent via electronic transmission to our dedicated legal desk or through our online support portal.

To ensure prompt processing without administrative delay, please send your notice with the subject line format DMCA Copyright Infringement Notice – [Content URL] to our legal desk at gencuebox@gmail.com or use the GenCueBox Support Portal.

If you are a copyright owner or an authorized agent and believe that content hosted on GenCueBox infringes upon your copyright, please provide our Designated Copyright Agent with a written notification containing all of the following statutory elements:

Infringing material is typically disabled or removed within 24 to 48 hours. Promptly following removal, we notify the uploader to inform them of the action taken and provide instructions for filing a counter-notification if they believe the removal was mistaken.

If a content publisher believes that their prompt or preview graphic was removed by mistake or misidentification, they may file a formal written counter-notification pursuant to 17 U.S.C. § 512(g)(3).

To be effective, a counter-notification must include: (1) physical or electronic signature of the subscriber; (2) identification of the material that was removed or disabled and the location where it previously appeared; (3) a statement under penalty of perjury that the subscriber has a good faith belief the material was removed or disabled as a result of mistake or misidentification; and (4) the subscriber's name, address, telephone number, and consent to federal court jurisdiction.

Upon receipt of a valid counter-notification, GenCueBox forwards a copy to the original complaining party. If the claimant does not notify us within 10 to 14 business days that they have initiated a court action seeking a restraining order against the subscriber, GenCueBox may restore the removed material.

In accordance with the DMCA and other applicable intellectual property laws, GenCueBox enforces a strict policy to terminate, in appropriate circumstances and at our sole discretion, user accounts and creator profiles belonging to subscribers who are deemed repeat copyright infringers.

Subscribers who receive multiple valid infringement strikes without prevailing in counter-notifications are subject to immediate account revocation, removal of all public prompt listings, and forfeiture of platform creator privileges.

Under United States copyright doctrine (17 U.S.C. § 107), fair use permits the unlicensed reproduction of copyrighted material under certain circumstances, including criticism, comment, news reporting, teaching, scholarship, or parody.

Because generative AI prompts often analyze or discuss art styles, cultural references, or educational motifs without reproducing original source assets, copyright owners must consider the doctrine of fair use prior to submitting an infringement notice. Submitting notices without fair use evaluation may expose the submitter to legal claims under 17 U.S.C. § 512(f).

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by a service provider injured by such misrepresentation.

Do not make false claims. If you are unsure whether material on GenCueBox infringes your copyright, please consult an attorney before filing a notice.
